1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 - The contract stipulated between My Cigarette and the Customer must be considered concluded with the acceptance, even if only partial, of the order by My Cigarette. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.
1.2 - If the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these conditions general sales, in compliance with the provisions of Articles 50 and following of Legislative Decree 206/05.
1.3 - Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
2. PURCHASE METHOD
2.1 - The Customer can only purchase the products in the electronic catalog of the website www.mycigarette.it at the time of placing the order, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics but may differ in color, size, accessory products shown in the figure. The sales prices include VAT. and all other taxes.
2.2 - The correct receipt of the order is confirmed by My Cigarette through an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of execution of the order and an order number, to be used in any further communication with My Cigarette. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, using the customer service.
2.3 - In the event of non-acceptance of the order, My Cigarette guarantees communication to the Customer by e-mail or telephone within seven days of receipt of the summary e-mail.
My Cigarette accepts orders for products within the limits of the quantities in stock, therefore the acceptance of the purchase proposal is subject to the availability of the products in stock. My Cigarette undertakes to promptly notify the Customer of any unforeseeable out of stock due to excess demand or other causes.
3. METHOD OF PAYMENT
3.1 - Purchases via Credit Cards: in cases of purchase of goods with credit card payment methods, at the same time as the online transaction is concluded, the relevant payment circuit will immediately charge the amount relating to the purchase made.
3.2 - Cash on delivery: in case of purchase on delivery, an additional contribution will be applied to the total amount, clearly highlighted when choosing the payment method. Payment, to be made directly to the courier, will be made upon delivery of the products. It is possible to pay only in cash, it is not possible to pay by checks.
3.3 - Bank Transfer: in case of purchase by bank transfer, within 24 hours of receiving the order confirmation email, My Cigarette will send a new order confirmation containing the bank details in order to make the payment; the goods will be shipped only after credit has been received. The transfer must be made within 3 days of the order.
4. METHOD AND DELIVERY COSTS
4.1 - For each order placed on the website www.mycigarette.it, My Cigarette issues either a (non-fiscal) receipt and a transport document accompanying the material shipped, referring to the information provided by the Customer when placing the order. After the receipt has been issued, it will not be possible to make changes to it.
4.2 - Delivery costs are charged to the Customer and are clearly stated when placing the order. Nothing more is owed by the Customer than the total order.
4.3 - No responsibility can be attributed to My Cigarette in case of delay in order fulfillment or delivery of the order.
4.4 - Upon delivery of the goods by the courier, the Customer is required to check:
that the number of packages delivered corresponds to what is indicated in the accompanying invoice or in the bulletin.
that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or strapsette).
Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately contested, affixing WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg. "Punctured packaging", "crushed packaging" , etc.) on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, according to the procedures set out in this document.
If the items are damaged with the package intact, follow the return procedure.
4.5 - In case of non-collection within 5 working days of the material present in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the My warehouses Cigarette.
4.6 - Refusal of cash on delivery is not contemplated by any Italian law. For cash on delivery shipments that will be refused without an appropriate reason (delay in delivery beyond 3 working days, damaged or wet packaging, non-fulfillment of the deliveries) the procedure for recovering shipping costs may be activated (at our discretion), opening storage of the courier, and return to the sender. The minimum amount of the reimbursement of expenses is 29.99 euros.
5. ORDERS
All orders must be received directly from the Site. Orders are EXCEPTIONALLY accepted by telephone or by e-mail subject to knowledge of the codes of the items to be purchased and the relative quantities. Orders by fax are not accepted. In fact, the receipt of orders placed from the Site allows us to automatically and immediately upload them to our computer system, thus minimizing the possibility of error. If the ordered items are available in the required quantity and variants, the orders are generally processed within 24 hours of receipt of the same.
6. CUSTOMER WARRANTIES
The Customer declares and guarantees:
to. to be of age and consumer in accordance with the provisions of art. 3 of the Consumer Code;
b. that the data provided by the same for the execution of the contract are correct, truthful and do not violate any third party rights.
7. PRIVACY
7.1 - The personal data requested when placing the order are collected and processed in order to satisfy the express requests of the Customer. My Cigarette guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree no. 196 of 30.06.03. 7.2 - Applicable law. The sales contract between the customer and My Cigarette is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Forum of Rome.
